１ ある事業のために他人を使用する者は、被用者がその事業の執行について第三者に加えた損害を賠償する責任を負う。ただし、使用者が被用者の選任及びその事業の監督について相当の注意をしたとき、又は相当の注意をしても損害が生ずべきであったときは、この限りでない。
（1） A person who employs others for a certain business shall be liable for damages inflicted on a third party by his/her employees with respect to the execution of that business; provided, however, that this shall not apply if the employer exercised reasonable care in appointing the employee or in supervising the business, or if the damages could not have been avoided even if he/she had exercised reasonable care.〔【出典】日本法令外国語訳データベースシステム 〕

１ 労働者を雇用しようとする者が、その被用者以外の者をして報酬を与えて労働者の募集に従事させようとするときは、厚生労働大臣の許可を受けなければならない。
（1） When a person who intends to employ workers wishes to have a person other than his/her employee engage in labor recruitment by giving compensation to such person, he/she shall obtain a license from the Minister of Health, Labour and Welfare.〔【出典】日本法令外国語訳データベースシステム 〕

３ 前二項の規定は、使用者又は監督者から被用者に対する求償権の行使を妨げない。

３ 労働者を雇用しようとする者が、その被用者以外の者をして報酬を与えることなく労働者の募集に従事させようとするときは、その旨を厚生労働大臣に届け出なければならない。

５ この法律において「労働者の募集」とは、労働者を雇用しようとする者が、自ら又は他人に委託して、労働者となろうとする者に対し、その被用者となることを勧誘することをいう。
（5） The term "labor recruitment" as used in this Act means that those who seek to employ workers solicit, either directly or through a third party, those seeking to become workers to become their employees.〔【出典】日本法令外国語訳データベースシステム 〕

三 異議申立人の同居人又は被用者

二 その被用者をして労働者の募集に従事させる者であつて、当該被用者が労働組合法第二条第一号の役員、監督的地位にある労働者又は使用者の利益を代表する者に該当するもの

労働者の募集を行う者は、その被用者で当該労働者の募集に従事するもの又は募集受託者に対し、賃金、給料その他これらに準ずるものを支払う場合又は第三十六条第二項の認可に係る報酬を与える場合を除き、報酬を与えてはならない。
A person carrying out labor recruitment shall not give any of his/her employees who is engaged in said labor recruitment or any commissioned recruiter any compensation, except in the case of paying wages or salaries or the equivalent thereof or in the case of giving compensation pertaining to the approval provided for in Article 36, paragraph 2.〔【出典】日本法令外国語訳データベースシステム 〕
