- １ 日本銀行は、第三十三条から前条までに規定する業務のほか、内閣総理大臣及び財務大臣の認可を受けて、第三十三条第一項第五号から第七号までに掲げる業務又は第三十五条第二項若しくは第三十六条第二項に規定する業務と一体的に行うことによって金融機関の間における資金決済の円滑に資すると認められる業務を行うことができる。
（1） In addition to the business prescribed in Article 33 through the preceding Article, the Bank of Japan may, upon authorization from the Prime Minister and the Minister of Finance, conduct the business deemed to contribute to smooth settlement of funds among financial institutions in conjunction with the business prescribed in Article 33, paragraph 1, items （v） through （vii） or the business prescribed in Article 35, paragraph 2 or Article 36, paragraph 2.〔【出典】日本法令外国語訳データベースシステム 〕
- １ 法第二十四条第一項 に規定する特定資本取引（以下「特定資本取引」という。）は次に掲げる契約に基づく債権の発生等に係る取引（国際商業取引の決済のための取引で当該取引に係る債権の発生から消滅までの期間が一年以内であるものを除く。）とする。
（1） Specified capital transactions prescribed in Article 24, paragraph 1 of the Act （hereinafter referred to as the "Specified Capital Transactions"） shall be the Transactions Pertaining to the Occurrence, etc. of Claims based on any of the following contracts （excluding transactions for settlement of international commercial transactions for which the period from the occurrence of claims pertaining to the transactions to extinguishment thereof is not longer than one year）.〔【出典】日本法令外国語訳データベースシステム 〕
- １３ 第二条第二十一項第二号に掲げる取引が現実数値に基づき金銭の授受により決済された場合、同項第三号に掲げる取引に係るオプションが行使されずに消滅した場合その他これらに類するものとして政令で定める場合における第一項の課徴金の計算に関し必要な事項は、政令で定める。
（13） With regard to the cases where a transaction listed in Article 2（21）（ii） has been settled by payment and receipt of money based on an Actual Figure, the cases where the Options pertaining to a transaction listed in Article 2（21）（iii） have been extinguished without being exercised and other cases specified by a Cabinet Order as being similar to these cases, the matters necessary for calculation of an administrative monetary penalty set forth in paragraph （1） shall be specified by a Cabinet Order.〔【出典】日本法令外国語訳データベースシステム 〕
- ２ 前項の場合においては、本人又はその承継者（会員又は取引参加者であるものを除く。）は、当該取引の決済を結了する目的の範囲内において、会員又は取引参加者とみなす。

- ２ 日本銀行は、前項に規定するもののほか、銀行その他の金融機関の間で行われる資金決済の円滑の確保を図り、もって信用秩序の維持に資することを目的とする。
（2） In addition to what is prescribed in the preceding paragraph, the Bank of Japan's purpose is to ensure smooth settlement of funds among banks and other financial institutions, thereby contributing to the maintenance of stability of the financial system.〔【出典】日本法令外国語訳データベースシステム 〕

- ３ 第一項の規定により商品取引所が他の会員等をして当該取引の決済を結了させるときは、本人又はその承継者と当該会員等との間には委任契約が成立しているものとみなす。

- ４ 前項の規定により商品取引所が他の会員等をして当該取引の決済を結了させるときは、当該会員等と当該取引の委託者との間には委任契約が成立しているものとみなす。
（4） When a Commodity Exchange has another Member, etc. complete settlement of said transactions pursuant to the provisions of the preceding paragraph, it shall be deemed that a Brokerage Contract is established between said Member, etc. and the customer of said transactions.〔【出典】日本法令外国語訳データベースシステム 〕
