２ 刑務官は、被収容者が自身を傷つけるおそれがある場合において、他にこれを防止する手段がないときは、刑事施設の長の命令により、拘束衣を使用することができる。ただし、捕縄又は手錠と同時に使用することはできない。

３ 保護室が設置されていない留置施設においては、留置担当官は、被留置者が留置担当官の制止に従わず大声を発し続けて、留置施設内の平穏な生活を乱す場合において、他にこれを抑止する手段がないときは、留置業務管理者の命令により、防声具を使用することができる。この場合において、その被留置者が防声具を取り外し、又は損壊することを防ぐため必要があるときは、その使用と同時に捕縄又は手錠を使用することができる。
（3） In cases of the detention facility without any protection room, if a detainee persistently generates a loud voice against a detention officer's order to cease doing so, thereby disturbing peaceful community life thereof, detention officers may use a gag by order of the detention services manager, if no other means are available. ４ 前二項に規定する場合において、留置業務管理者の命令を待ついとまがないときは、留置担当官は、その命令を待たないで、拘束衣又は防声具（前項後段の規定により使用する捕縄又は手錠を含む。）を使用することができる。この場合には、速やかに、その旨を留置業務管理者に報告しなければならない。
（4） In the case prescribed in the preceding paragraph, if there is no time to wait for the order from the detention services manager, then detention officers may use a restraint suit or gag （including the use of arresting ropes and handcuffs pursuant to the provision of the latter part in the preceding paragraph） without the order.
