情緒障害児短期治療施設は、軽度の情緒障害を有する児童を、短期間、入所させ、又は保護者の下から通わせて、その情緒障害を治し、あわせて退所した者について相談その他の援助を行うことを目的とする施設とする。

乳児院、母子生活支援施設、児童養護施設、情緒障害児短期治療施設及び児童自立支援施設の長は、当該施設の所在する地域の住民に対して、その行う児童の保護に支障がない限りにおいて、児童の養育に関する相談に応じ、及び助言を行うよう努めなければならない。

児童養護施設、知的障害児施設、盲ろうあ児施設、肢体不自由児施設、情緒障害児短期治療施設及び児童自立支援施設の長並びに里親は、学校教育法に規定する保護者に準じて、その施設に入所中又は受託中の児童を就学させなければならない。
