１ 姻族関係は、離婚によって終了する。

２ 夫婦の一方が死亡した場合において、生存配偶者が姻族関係を終了させる意思を表示したときも、前項と同様とする。

ロ 直系血族又は直系姻族以外の者の養子（届出をしていないが、事実上養子縁組関係と同様の事情にある者を含む。）となったこと。

三 三親等内の姻族

二 公益委員が事件の当事者の四親等以内の血族、三親等以内の姻族又は同居の親族であり、又はあつたとき。

二 執行官が当事者の四親等内の血族、三親等内の姻族又は同居の親族であるとき。

二 裁判官が当事者の四親等内の血族、三親等内の姻族若しくは同居の親族であるとき、又はあったとき。

直系姻族の間では、婚姻をすることができない。第七百二十八条又は第八百十七条の九の規定により姻族関係が終了した後も、同様とする。

被害者の法定代理人が被疑者であるとき、被疑者の配偶者であるとき、又は被疑者の四親等内の血族若しくは三親等内の姻族であるときは、被害者の親族は、独立して告訴をすることができる。
