１ 国は、必要があると認めるときは、選定事業の用に供する間、国有財産（国有財産法第二条第一項に規定する国有財産をいう。）を無償又は時価より低い対価で選定事業者に使用させることができる。

１２ 国有財産法第二十一条及び第二十三条から第二十五条までの規定は第一項から第五項までの規定による貸付けについて、地方自治法第二百三十八条の二第二項及び第二百三十八条の五第三項から第五項までの規定は第六項から第十項までの規定による貸付けについて、それぞれ準用する。
（12） The provisions of Articles 21 and 23 to 25 inclusive of the National Property Act shall apply mutatis mutandis to leases set forth in paragraphs （1） to （5） inclusive of this article. ６ 国有財産法第二十一条及び第二十三条から第二十五条までの規定は第一項の貸付けについて、地方自治法第二百三十八条の二第二項及び第二百三十八条の五第四項から第六項までの規定は第四項の貸付けについて、それぞれ準用する。

６ 港湾管理者は、国有財産法第十八条第一項又は地方自治法第二百三十八条の四第一項の規定にかかわらず、特定埠頭を構成する行政財産（国有財産法第三条第二項又は地方自治法第二百三十八条第四項に規定する行政財産をいう。）を第二項の認定を受けた者に貸し付けることができる。
