１ エネルギー管理士免状は、次の各号のいずれかに該当する者に対し、経済産業大臣がこれを交付する。

１ 主任技術者免状の種類は、次のとおりとする。

１ 事業用電気工作物を設置する者は、事業用電気工作物の工事、維持及び運用に関する保安の監督をさせるため、経済産業省令で定めるところにより、主任技術者免状の交付を受けている者のうちから、主任技術者を選任しなければならない。

１ 指定試験機関は、試験事務を行う場合において、第四十四条第一項第一号から第三号までに掲げる種類の主任技術者免状に係る主任技術者として必要な知識及び技能を有するかどうかの判定に関する事務については、試験員に行わせなければならない。

１ 新法第四十五第一項の電気主任技術者試験に関する事務（第三種電気主任技術者免状に係る電気主任技術者試験の実施に関する事務を除く。）をつかさどらせるため、平成九年四月一日までは、通商産業省に電気主任技術者資格審査委員を置く。

２ 公務員に対し虚偽の申立てをして、免状、鑑札又は旅券に不実の記載をさせた者は、一年以下の懲役又は二十万円以下の罰金に処する。

２ 前条第一項の規定により同項第一号に掲げる者のうちからエネルギー管理員を選任した第一種指定事業者は、前項の規定により中長期的な計画を作成するときは、経済産業省令で定めるところにより、エネルギー管理士免状の交付を受けている者を参画させなければならない。

２ 前項の規定により免状交付事務の委託を受けた指定試験機関の役員若しくは職員又はこれらの職にあつた者は、当該委託に係る免状交付事務に関して知り得た秘密を漏らしてはならない。

２ 前項の規定により免状交付事務の委託を受けた法人の役員若しくは職員又はこれらの職にあつた者は、当該委託に係る免状交付事務に関して知り得た秘密を漏らしてはならない。

２ 危険物取扱者が取り扱うことができる危険物及び甲種危険物取扱者又は乙種危険物取扱者がその取扱作業に関して立ち会うことができる危険物の種類は、前項に規定する危険物取扱者免状の種類に応じて総務省令で定める。

２ 消防吏員又は警察官は、危険物の移送に伴う火災の防止のため特に必要があると認める場合には、走行中の移動タンク貯蔵所を停止させ、当該移動タンク貯蔵所に乗車している危険物取扱者に対し、危険物取扱者免状の提示を求めることができる。この場合において、消防吏員及び警察官がその職務を行なうに際しては、互いに密接な連絡をとるものとする。
（2） A firefighter or a police official, when he/she finds it particularly necessary for prevention of fire involving conveyance of hazardous materials, may stop a mobile tank storage facility while in transit and request the hazardous materials engineer who is riding on said mobile tank storage facility to present his/her hazardous materials engineer's license. ２ 第十三条の二第四項から第七項までの規定は、消防設備士免状について準用する。

２ 自家用電気工作物を設置する者は、前項の規定にかかわらず、経済産業大臣の許可を受けて、主任技術者免状の交付を受けていない者を主任技術者として選任することができる。

２ 製造保安責任者免状又は販売主任者免状の交付を受けている者が高圧ガスの製造又は販売に係る保安について職務を行うことができる範囲は、前項に掲げる製造保安責任者免状又は販売主任者免状の種類に応じて経済産業省令で定める。
（2） The scope of duties that may be performed by a holder of a Production Safety Management Certificate or a Sales Safety Chief Certificate for the safety of production or sale of high pressure gas shall be provided for in an Ordinance of METI for each classification of Production Safety Management Certificates or Sales Safety Chief Certificates given in the preceding paragraph.〔【出典】日本法令外国語訳データベースシステム 〕

２ 製造保安責任者試験又は販売主任者試験は、第二十九条第一項に規定する製造保安責任者免状又は販売主任者免状の種類ごとに、毎年少なくとも一回、経済産業大臣又は都道府県知事が行う。

３ ガス主任技術者免状は、次の各号のいずれかに該当する者でなければ、その交付を受けることができない。

３ 危険物取扱者は、第一項の規定により危険物の移送をする移動タンク貯蔵所に乗車しているときは、危険物取扱者免状を携帯していなければならない。

３ 危険物取扱者免状は、危険物取扱者試験に合格した者に対し、都道府県知事が交付する。

３ 文部科学大臣及び経済産業大臣は、原子炉主任技術者免状の交付を受けた者がこの法律又はこの法律に基く命令の規定に違反したときは、その原子炉主任技術者免状の返納を命ずることができる。

３ 経済産業大臣は、核燃料取扱主任者免状の交付を受けた者がこの法律又はこの法律に基づく命令の規定に違反したときは、その核燃料取扱主任者免状の返納を命ずることができる。

３ 経済産業大臣は、次の各号のいずれかに該当する者に対しては、主任技術者免状の交付を行わないことができる。

３ 製造保安責任者免状又は販売主任者免状は、高圧ガス製造保安責任者試験（以下「製造保安責任者試験」という。）又は高圧ガス販売主任者試験（以下「販売主任者試験」という。）に合格した者でなければ、その交付を受けることができない。

３ 製造所、貯蔵所及び取扱所においては、危険物取扱者（危険物取扱者免状の交付を受けている者をいう。以下同じ。）以外の者は、甲種危険物取扱者又は乙種危険物取扱者が立ち会わなければ、危険物を取り扱つてはならない。

４ 前項の規定による廃止前の熱管理法第十二条の規定により交付された熱管理士免状は、第八条第一項の規定により交付された熱管理士免状とみなす。

４ 第一項第一号の原子炉主任技術者試験の課目、受験手続その他原子炉主任技術者試験の実施細目並びに原子炉主任技術者免状の交付及び返納に関する手続は、文部科学省令・経済産業省令で定める。

４ 第一項第一号の核燃料取扱主任者試験の課目、受験手続その他核燃料取扱主任者試験の実施細目並びに核燃料取扱主任者免状の交付及び返納に関する手続は、経済産業省令で定める。

４ 経済産業大臣は、主任技術者免状の交付を受けている者がこの法律又はこの法律に基づく命令の規定に違反したときは、その主任技術者免状の返納を命ずることができる。

５ この法律の施行の際現に旧法第十三条の二第三項の規定により甲種危険物取扱主任者免状又は乙種危険物取扱主任者免状の交付を受けている者は、それぞれ新法第十三条の二第三項の規定により甲種危険物取扱者免状又は乙種危険物取扱者免状の交付を受けている者とみなす。
（5） A person who, at the time of the enforcement of this Act, has been granted a Class A hazardous materials specialist license or a Class B hazardous materials specialist license pursuant to the provision of Article 13-2, paragraph （3） of the former Act shall be respectively deemed to have been granted a Class A hazardous materials engineer's license or a Class B hazardous materials engineer's license under Article 13-2, paragraph （3） of the new Act.〔【出典】日本法令外国語訳データベースシステム 〕

５ 危険物取扱者がこの法律又はこの法律に基づく命令の規定に違反しているときは、危険物取扱者免状を交付した都道府県知事は、当該危険物取扱者免状の返納を命ずることができる。

５ 製造保安責任者免状又は販売主任者免状の交付に関する手続的事項は、経済産業省令で定める。

６ 都道府県知事は、その管轄する区域において、他の都道府県知事から危険物取扱者免状の交付を受けている危険物取扱者がこの法律又はこの法律に基づく命令の規定に違反していると認めるときは、その旨を当該他の都道府県知事に通知しなければならない。
（6） When a prefectural governor finds, within the area under his/her jurisdiction, that any hazardous materials engineer who has obtained a hazardous materials engineer's license from another prefectural governor is in violation of the provisions of this Act or orders under this Act, he/she shall give notice to such other prefectural governor to that effect.〔【出典】日本法令外国語訳データベースシステム 〕
