児童又は児童以外の満二十歳に満たない者（次条及び第三十三条の八において「児童等」という。）の親権者が、その親権を濫用し、又は著しく不行跡であるときは、民法 （明治二十九年法律第八十九号）第八百三十四条 の規定による親権喪失の宣告の請求は、同条に定める者のほか、児童相談所長も、これを行うことができる。
When the person who has parental authority over a child or over a person under 20 years of age other than children （referred to as "Child, etc." in the following Article and Article 33-8） abuses his/her parental authority or misbehaves extremely, a request for adjudication of forfeiture of parental authority pursuant to the provision of Article 834 of the Civil Code （Act No. 89 of 1896） may be made by the child guidance center's director, in addition to the persons prescribed in the same Article.〔【出典】日本法令外国語訳データベースシステム 〕

児童等の未成年後見人に、不正な行為、著しい不行跡その他後見の任務に適しない事由があるときは、民法第八百四十六条の規定による未成年後見人の解任の請求は、同条に定める者のほか、児童相談所長も、これを行うことができる。

後見人に不正な行為、著しい不行跡その他後見の任務に適しない事由があるときは、家庭裁判所は、後見監督人、被後見人若しくはその親族若しくは検察官の請求により又は職権で、これを解任することができる。

父又は母が、親権を濫用し、又は著しく不行跡であるときは、家庭裁判所は、子の親族又は検察官の請求によって、その親権の喪失を宣告することができる。
