１ 管轄裁判所が法律上又は事実上裁判権を行うことができないときは、その裁判所の直近上級の裁判所は、申立てにより、決定で、管轄裁判所を定める。

裁判の執行は、その裁判をした裁判所に対応する検察庁の検察官がこれを指揮する。但し、第七十条第一項但書の場合、第百八条第一項但書の場合その他その性質上裁判所又は裁判官が指揮すべき場合は、この限りでない。
