- （３） 市場デリバティブ取引又は外国市場デリバティブ取引の委託の勧誘

- １０ 第二項第十二号若しくは第十三号の「デリバティブ取引」又は第二項第十六号若しくは第十七号の「有価証券関連店頭デリバティブ取引」とは、それぞれ金融商品取引法第二条第二十項（定義）に規定するデリバティブ取引又は同法第二十八条第八項第四号（定義）に掲げる行為をいう。

- １４ この法律において「金融商品市場」とは、有価証券の売買又は市場デリバティブ取引を行う市場をいう。

- １９ この法律において「取引参加者」とは、第百十二条第一項又は第百十三条第一項の規定による取引資格に基づき、取引所金融商品市場における有価証券の売買又は市場デリバティブ取引に参加できる者をいう。

- ２ 前条第四項の規定による取引所金融商品市場における有価証券の売買又は市場デリバティブ取引の委託者の優先権は、前項の優先権に対し、優先の効力を有する。

- ２ 前項の規定は、市場デリバティブ取引及び店頭デリバティブ取引について準用する。

- ２ 前項の規定は、金融商品取引業者等又は金融商品仲介業者が、この法律の定めるところに従つて有価証券の売買若しくは市場デリバティブ取引（取引所金融商品市場によらないで行われるものを除く。）又はこれらの取引の媒介、取次ぎ若しくは代理を行う場合には、適用しない。

- ２ 前項の金融商品取引責任準備金は、有価証券の売買その他の取引又はデリバティブ取引等に関して生じた事故による損失の補てんに充てる場合その他内閣府令で定める場合のほか、使用してはならない。

- ２ 取次者は、市場デリバティブ取引の委託の取次ぎの引受けについて、内閣府令で定めるところにより、申込者に、当該取次者に取次証拠金を預託させることができる。

- ２ 市場デリバティブ取引に係る有価証券等清算取次ぎの委託の取次ぎについては、有価証券等清算取次ぎを委託した顧客を当該市場デリバティブ取引の取次ぎを行う者とみなして、第百十九条第一項から第三項までの規定を適用する。

- ２ 金融商品取引業者等は、その行うデリバティブ取引等に関し、顧客の計算に属する金銭及び金融商品の価額に相当する財産については、内閣府令で定めるところにより、管理しなければならない。

- ２０ この法律において「デリバティブ取引」とは、市場デリバティブ取引、店頭デリバティブ取引又は外国市場デリバティブ取引をいう。
（20） The term "Derivative Transactions" used in this Act means Market Transactions of Derivatives, Over-the-Counter Transactions of Derivatives or Foreign Market Derivatives Transactions.〔【出典】日本法令外国語訳データベースシステム 〕
- ２２ この法律において「店頭デリバティブ取引」とは、金融商品市場及び外国金融商品市場によらないで行う次に掲げる取引（その内容等を勘案し、公益又は投資者の保護のため支障を生ずることがないと認められるものとして政令で定めるものを除く。）をいう。
（22） The term "Over-the-Counter Transactions of Derivatives" as used in this Act means the following transactions which are conducted in neither a Financial Instruments Market nor a Foreign Financial Instruments Market （except those specified by a Cabinet Order as those for which it is found not to hinder the public interest or protection of investors when taking into account its content and other related factors）.〔【出典】日本法令外国語訳データベースシステム 〕
- ２３ この法律において「外国市場デリバティブ取引」とは、外国金融商品市場において行う取引であつて、市場デリバティブ取引と類似の取引をいう。
（23） The term "Foreign Market Derivatives Transactions" as used in this Act means transactions which are conducted in a Foreign Financial Instruments Market and are similar to Market Transactions of Derivatives.〔【出典】日本法令外国語訳データベースシステム 〕
- ３ 法第六条第一項第十四号に規定する政令で定める市場デリバティブ取引は、次に掲げるものとする。

- ４ 会員等に対して取引所金融商品市場における有価証券の売買又は市場デリバティブ取引の委託をした者は、その委託により生じた債権に関し、当該会員等の信認金について、他の債権者に先立ち弁済を受ける権利を有する。

- ４ 法第六条第一項第十四号に規定する政令で定める店頭デリバティブ取引は、次に掲げるものとする。

- ４ 第二項第二号又は第十二号の「有価証券関連デリバティブ取引」又は「書面取次ぎ行為」とは、それぞれ金融商品取引法（昭和二十三年法律第二十五号）第二十八条第八項第六号（定義）に規定する有価証券関連デリバティブ取引又は同法第三十三条第二項（金融機関の有価証券関連業の禁止等）に規定する書面取次ぎ行為をいう。
（4） The terms "Derivative Securities Transactions" and "Brokerage with Written Orders" as used in paragraph （2）, items （ii） and （xii） respectively mean the Derivative Securities Transactions defined in Article 28, paragraph （8）, item （vi） （Definitions） of the Financial Instruments and Exchange Act （Act No. 25 of 1948） and the Brokerage with Written Orders defined in Article 33, paragraph （2） （Prohibition, etc. of Securities Services by Financial Institutions） of that Act.〔【出典】日本法令外国語訳データベースシステム 〕
- ６ この法律において「デリバティブ取引」とは、金融商品取引法第二条第二十項に規定するデリバティブ取引をいう。

- ６ 第百十五条第一項の規定は、第一項の取引証拠金（内閣府令で定めるものに限る。）について準用する。この場合において、同条第一項中「有価証券の売買又は市場デリバティブ取引」とあるのは、「市場デリバティブ取引」と読み替えるものとする。
（6） Article 115（1） shall apply mutatis mutandis to the clearing margin under paragraph （1） （limited to those specified by a Cabinet Office Ordinance）. - ７ 合併により消滅した金融商品取引所の開設していた取引所金融商品市場において成立した有価証券の売買及び市場デリバティブ取引であつて決済を結了していないものは、合併後金融商品取引所の開設する取引所金融商品市場において同一の条件で成立した取引とみなす。
（7） The sales and purchase of Securities and Market Transactions of Derivatives closed on a Financial Instruments Exchange Market established by a Financial Instruments Exchange extinguished as a result of a merger of which settlements have not been completed shall be deemed to have been closed on the Financial Instruments Exchange Market established by the Financial Instruments Exchange Resulting from a Merger under the same conditions.〔【出典】日本法令外国語訳データベースシステム 〕
- ８ 第一項第六号又は第七号の「デリバティブ取引」又は「有価証券関連デリバティブ取引」とは、それぞれ金融商品取引法第二条第二十項（定義）に規定するデリバティブ取引又は同法第二十八条第八項第六号（定義）に規定する有価証券関連デリバティブ取引をいう。
（8） The term "Derivative Transactions" or "Transactions of Securities-Related Derivatives" set forth in paragraph （1）, item （vi） or （vii） respectively means the Derivative Transactions prescribed in Article 2, paragraph （20） （Definitions） of the Financial Instruments and Exchange Act or the Transactions of Securities-Related Derivatives prescribed in Article 28, paragraph （8）, item （vi） （Definitions） of that Act.〔【出典】日本法令外国語訳データベースシステム 〕
